Two nurses have been cleared of injuring a quadriplegic patient at Horace Nye Nursing Home.
All charges against Billie Jo O'Donnell, 38, of Witherbee and Anne Marcotte, 49, of Willsboro were dismissed by Justice William Garrison April 22 during an appearance in Elizabethtown town court.
The two nurses had been charged in January with misdemeanor counts of second-degree reckless endangerment, endangering the welfare of an incompetent person and violation of the State Public Health Law.
The State Attorney General's Office alleged they caused severe trauma to a patient during a routine catheterization procedure in November 2008 and then failed to provide medical treatment for several hours.
In his dismissal, Garrison cited the results of medical tests performed on the patient at CVPH Medical Center that showed his urinal bleeding was caused by bladder carcinoma, not the catheterization.
The nurses had been suspended with pay by Horace Nye Nursing Home, which is owned by Essex County.
